I haven't purchased anything from Dell small business since March... It's been a while.. I logged in tonight to check my account and update my address and lo and behold I see that an order has been placed on July 26th, 2004 (a few days ago) .. Well, it certainly wasn't me..... So I'm like "wtf mate" and I click on it.

Turns out it was a warranty part (net 15 replacement) for some unspecified piece of equipment. It got shipped to an individual in Plattsburgh, NY.

I do not know who this person is. Whoever he is, he sent a package to Dell (probably the defective part) and sent it AS SARCNET INDUSTRIES, INC (my company name)..... I wasn't aware that I had a Plattsburgh, NY branch office.

So now, I am almost positive that this dude has one of my stolen pieces of equipment (remember the big robberies from last year?) .... It's either -tk's laptop or one (or both) of my 19" flat panels..... I called the guy just now and got an answering machine "Hello this is the ortloff residence..." so it's just some house....

Who lives close to this guy? I WANT MY **** BACK.

Oh this guy is so ****ing nailed. I am so fired up.

Even if he bought the stolen equipment he's in possession of stolen property, which is a crime in most, if not all, states. It'll possibly lead to the culprit if that's the case. Ya know, for twenty dolla's we can have his legs broken and still get a little change back. Hope it turns out well for you :)

Recieving stolen property carries pretty close the same sentance as stealing it in the first place and if he recieved it he knows who took it. The cops will use the fact of it carrying the close penalty to extract the info they want about the real culprit so either way it's a good thing, either this scumball did it or knows the scumbag(s) that did do it.
I hope they get the idiot(s) responsible and nail their sack(s) to the wall

Straight_Man

Me too.... Brian deserves a big break on this one. But, he need to let Dell know someone bought something using HIS account so that Dell can set up security and only ship to his office or a place he designates, or sells to only cards where the ship-to address is his address as well as the bill-to.

In other words, make sure an ID Theft check is done also, and further ID Theft prevention is done.... Anyone who acessed the info on that laptop, if it had Brian's credit info on it, could play all sorts of games, or sell the info to someone who could do so. If his account has a PIN on it and that PIN could be compromised, change the PIN to the account, credit card and\or Dell account.

My guess is this guy MIGHT have used a drop ship ability on the Dell account to get the part shipped to Plattsburg. That account needs to be code-worded or PIN-verified or security question authed for dropship to happen. And Dell needs to know they need to protect the account, and if a CC was used, the CC bank providing the CC also needs to have a way to do this.

This is at least TWO crimes and is probably more like four: theft, fraudulent purchase (interstate because of ship-to, possibly WITH telecomm fraud involved), interstate transport of stolen goods, and ID Theft acspects possibly could get involved if accounts involved are not secured), go after the idiot(s) who did each for each or both if they are the same person(s) doing both. The Interstate stuff, the FBI needs to be involved in. Dell will co-operate with the FBI as far as providing the evidence of sale of part. Add federal charges to local and state level charges. People get real co-operative real quick when total time and money penalties heap up real big.

Well I wish I was home now. I grew up just outside the "burg" as it was known. We had a dairy farm just outside Saranac Lake there on the map. My sister and parents still live there. I haven't been up there myself in 15 years or so.

And its a LONG drive from NYC to get up there. Vermont, Ottawa, Montreal are all a lot closer. If you called the cops in the burg which one of the two was on duty? :) I imagine it has grown a bit since I left there in '72.

Good Luck on gettin him or the real culprit who sold it to him. People up there used to think everybody was up front and honest. Hell we never even locked the doors. Was really a straight up kinda place way back.

Give it three days and burn the phone lines up to the detective division. Don't wait for them to call you. Have case number in hand and ask to speak to the detective assigned to your case. It shouldn't take more than a few days to have a detective assigned to it. Due to manpower issues at departments around the country, it's "the squeaky wheel gets the grease". I couldn't stress that enough for those filing reports at our department and from what I'm told at other departments it's the same. Unfortunately, many times the only way to get progress is to ask for it repeatedly. If not, you may find yourself waiting a long time.

Just my two cents...

I'm glad to hear that B might actually get some of his stolen equipment back. He definately deserves it considering how many times this has happened to his business.

I would also offer up the suggestion, as unsolicited that it may be, that at this time no one knows definitively the suspected individuals level of involvement in the crime, if any.

I am aware of instances where individuals have sold equipment that were still under warranties that were non-transferrable. They informed the purchaser that if they needed to use the warranty service they would have to claim they were an employee of the registered organization. I'm only suggesting that there maybe be a plausible explanation why this individual had the equipment and used the SarcNET name.

Ocomik, I am of the same mind. I really don't think some shlub from a small town in upstate new york had anything at all to do with the robberies. There was a laptop store here in Cincinnati called 'AAA Laptops'. The guy who owned the place was real nice, and he was always willing to negotiate prices with me. Whenever Sticky51 or I needed a laptop or laptop stuff, we would go there, cause of his good service and prices, and if we met someone who asked us about good laptop deals, we would refer them to AAA. His bussiness was doing very well.

Then, about a year and a half (or so) ago, he was arrested, and all of his merchandise was seized. Turns out that it was all hot. Nobody had any idea.

Of course, he wasen't dumb enough to tell us to use some other company's name for the waranty... He just sold everything 'as is'.

primesuspect
24 Aug 2004, 8:49pm
stolen laptop update:

I talked to the Detective today. She said that he probably didn't actually steal the laptop, that he probably bought it. Therefore, since we have no proof that he was the thief, it might be hard to get him on theft. However, he SIGNED for a package and represented that he was from Sarcnet Industries, Inc. which IS fraud. Therefore he has not only committed fraud, but he has at the very least accepted stolen property, and since he signed as SARCNET, he probably KNEW it was stolen.

He has committed fraud across state lines (ouch), at the very least. The detective is going to talk to the legal folks to find out exactly how we should pursue this. She'll be calling me tomorrow. More updates as they come.

Camman,

As former Air Force Law Enforcement, your answer is a resounding "YES" to both parts. These are Federal Laws, so it applies to both civilians & military members.

You can be charged with receiving stolen goods. It falls under "ignorance is not an excuse" aspect of the law.
Any stolen property you have will be confiscated, with NO reimbursement to you.

Don't call him. Call Dell, and call the police. I'd start with the cops and talk to them about how you should pursue it. Tell them what you found, tell them where you think it is, they'll tell you how to go about getting your stuff back. Do not, I repeat, DO NOT call the guy who has it. He may be aware it was hot merchandise and he may not, you don't know. I suggest you avoid contact with him until the police say otherwise.

As for stolen property, he has to know it was hot. If the person sold it to him with warranty info, numbers to call if something broke, etc etc...chances are it could have appeared to be a legitimate sale. Thats nothing you can worry about now anyway. That comes later. For now, contact your local police department.

*Edit* Seems you've done alot of that, good job! Just saw the "calling him now" bit and I was compelled to respond NO!!! immediately =)

If you bought it from some dude at a flea market and he said, 'It's still under warranty, but you have to say you're from sarcnet industries cause blah blah blah" then THAT'S fishy... All I'm saying is that there's almost always something wrong that a little voice in the back of your head would say "gee, maybe there's something wrong here...." but then your "deal" instinct kicks in and says "no, this guy seems genuine. In the Uk, once the insurance has been paid out, any recovered property belongs to the insurance company. It's then upto them if they let you keep the stuff, or sometimes you can buy it off them at a good price.

Prime,

This is so cool! Glad you're getting some of your stuff back.

So do you think this N00B in Portland is the thief, or another link in the chain?

It seems more realistic that the portland guy is probably just a link in the chain.

I am impressed that you are getting your LT back. If the same was to happen here you probably woul not get the police to investigate. And if they did they would hold the LT for evidence for a zillion years....

I am pleased for your good fortune. Must be something you've done to deserve it!

if you keep tracing this **** back you'll eventually find the person that stole your stuff. then possibly find more stolen items. dont let this slip away prime.

Wow! what an ironic series of events. I had to subscribe to thisun!

Thats awesome that your getting the stuff back! Nice work there on the investigation as well!

I hope you can trace back to the thievs and eventually get some restitution for all of it.

Although getting full restitution in these situations is a rarity, as the thieves seldomly own any valuable assets to sieze. But at least they will be off the streets for a while, preventing them from doing it again for a while.

Good luck prime!

One month later, and an update :rarr:

I got a phone call tonight from the guy who actually has it (Jon)...

He ordered a new computer yesterday, and when it gets there, he's shipping this one to me :D :D :D

His homeowner's insurance is actually going to cover some of it  -- that's lucky for him.

The plattsburgh police as well as Jon himself have both been trying to track down this cliff busby guy. No word from him yet..... :shakehead

Updates as they come.....

No, they couldn't since he was in Rochester, NY and they were in Plattsburgh (He goes to college in rochester)... They had to wait to investigate the cliff busby thing and then find out from his homeowner's insurance what the deal was. Now that it is all straightened out, he's sending it to me.

The important question: Has folding@home been installed yet?

On a previous account there was a break in and stuff stolen. I told em to check the local pawn shop. They didn't, so I did. You'll never guess who was right!
