A year ago last November I was in a car accident. Nothing serious, just a small shunt as a female driver drove into me at a roundabout. She had come through a red light, hit me then drove off. I chased her and we exchanged insurance details. She and her insurance company have always insisted I came through a red light without stopping, which isn't true, I had stopped at a red light and moved off when it chanded to green, honestly. As niether of us have witnesses my insurance offered to settle 50-50, both companys paying half the repair costs. Her insurance refused and eventually sued me in court. I went yesterday. My insurance had gone up 20% because of this and I had to pay £150 excess. Anyhow, after what the judge called "a manful cross examination" by the other sides weasle of a solicitor the judge believed me and found in my favour. I am now cleared of any responcibility for the accident, get my 20% and £150 back and even get the £6.50 it cost me to park at the court. Her insurers did all this to get the other half of her repair bill which was only £850 in total, now it has cost them £2500. Victory! the justice system works. :thumbsup:

I'm happy to hear that you were able to finally get things squared away in your favour.

It's a real pain not having independent witnesses, caused mainly by her taking off and you having to chase her, i guess.

That was one of my arguments. I could have had two witnesses but had to chase her, she pulled up half a mile away.

I doubt this would happen in America, at least in my experiences Justice seems to never be fair in cases like this. :shakehead

Awesome- score one for the little guy. I have always said that integrity cuts through the BS.

My bro had a similar thing happen. The judge took one look at the self-centered stuck-up cow in the chair and found for my brother. The only dumb thing is that here in Canada she can still sue him civilly for some recovery of costs to fix the car...she never did tho, thank God.

I know what you mean Spinner, I was expecting it would go 50-50 as neither of us had any witnesses so I just went and told the truth, I was totaly honest and it must have shown. Still buzzin with it. :D

The thing thats made an impact on me with this is, I've always been very honest, if something is true it's true, changing the facts doesn't change the facts. I value a clear consience above 'winning' every time but being honest has very often backfired and the liars and\or cheats win more often than not. The fact that I went and told it like it was and everybody believed me makes me feel good. The truth will out! :D

You deserve it and they deserve what they go too. ;)

It is now 1 1/2 weeks short of a year since my car was totaled by a dump truck and they have still been draging it out. A little over 2 months ago my insurance company won in court on the property damages as they were insisting I was at fault and drove my little car into 55,000 lbs of truck and dirt. :rolleyes: Now I am still waiting for my day in court for my injury claim for $6,000 in medical bills and $11,000 in lost wages to prevail.

Good news indeed bothered. Glad you got good results. Many times it doesn't go that way. It's nice to see it turn out on the side of truth for once.

A personal gripe of mine is that being "fair" often seems to entail splitting everything down the middle. This only makes sense if you want to look at it like the person in the right only got half-screwed and the one in the wrong only got half-punished.

I'm glad to hear that justice was done, at least in this case. :)

I know what you mean about the liars and cheats winning more often than not, but it sure feels good when being truthful finally pays off, eh?

Almost makes an honest person feel like its worth it :wink:
