Sounds like the students clicked onto a site that brought up popups. We all know this can happen. If she goes to jail it will be a travesty of justice.

The only thing that bothered me was reading in an article about it that she didn't shut down the PC because she had strict orders to keep it running. Hello, McFly?? We aren't too smart now are we. From the sounds of it shes a moron but she doesn't deserve ANY prison time for that esp because they have no real way of proving she actually meant to do it.

Yeah she didn't at least turn off the monitor ...that's her fault. There should be ways to administer the internet in a classroom so that these accidents don't happen. If such a method is in place but not being used at that school then send the admin to jail for 40 years not the sub.

I don't think its a very big deal..... everybody has seen it, everybody will see it. Just watching TV, commercials, billboards, and magazine ads is close enough to p0rn. I think they should've just fired her if they thought she was involved. And why didn't the school have a filtering system on their server in the first place?
Americans are too prudish. 40 years for something every kid is going to see in five years anyhow.

I get the sneaking suspicion that this is very shallow reporting and there are salient facts we aren't seeing. But then, maybe it really is simple: she wasn't smart enough (or panicked) and did not turn off the machine, the jury got emotional and didn't know a thing about malware.

I don't think she should get any jail time for it. I'm sure Leo hit the nail on the head about the reporting though. Seems to me that the school really doesn't care about what makes it onto their computers anyway since the article said "Principal Scott Fain said the computer lacked the latest firewall protection because a vendor’s bill had gone unpaid" So I mean with them not taking any actions to stop crap from getting into their network, why get angry when something does. But the way our legal system works she will get put behind bars, while some guy that likes to touch little kids gets 2 years in prison.

Wow, 40 years is a long time...
I've bypassed this thread several times because I knew it would only piss me off.... AND I WAS RIGHT! I HATE THESE IDIOTS!
I don't know this lady, but she's an idiot for not throwing a coat over the PC or something if she can't turn it off.
The schools and idiot for not keeping it's **** up to date, yeah that short period of time without updates can make a difference! Especially in an ever changing porn industry and advertisement/ad ware/spy ware world.
The police are idiots for not checking logs and for spyware.
OK let me be reasonable and put in some assumptions... obviously this lady is an idiot, but an innocent idiot if there were such a thing. She sure as hell doesn't deserve 40 god damned years in prison for things these kids more than likely look at ALREADY on mom's and dad's 100% open and insecure PC. She was obviously scared and freaked out of her mind which is why she couldn't think enough to cover the damned PC.
Someone should have logs or the PC disconnected from the internet so someone with SOME intellect can check the PC thoroughly and find out if it was spy ware and were it may have come from, the network admin should have logs of everything from that day.
I mean this whole case should be thrown out the door if you ask me, it's utter bull****, as the article mentioned... it's like someone forgetting to fingerprint a room full of evidence, and to add to that they BURNED the ****ing evidence IMHO.
40 years!??!?!?!?!?!? WTF!? As someone here mentioned, a child molester gets like 2 years and a slap on the wrist!
This lady has just been thrown to the dogs by her own people, I feel really bad for her.
Ohh yeah, and the prosecutor for this case should be shot. Along with everyone else who tried/trying to give this woman 40 years for this bull****.
