VIENNA (Reuters) - A woman lay awake during surgery for 45 minutes, unable to move or call for help, after staff forgot to hook up the machine pumping out anaesthetic, the Austrian daily Kurier reported Monday.
The woman was temporarily paralyzed because she had been given a muscle relaxant, and her ordeal ended only after a replacement doctor who came into the operating room saw tears in her eyes and noticed the machine was not connected properly.
The woman, who was undergoing abdominal surgery, is suing for 70,000 euro ($79,970) in damages, the hospital in the Austrian province of Carinthia confirmed.
OMG!!!1111!!!!!@#$!@! thats crazy. and not that 79 grand is any amount of money that i will see in my lifetime, but isnt that kinda small compared to what people normally file for with this kind of offense. man, that totally sucks . . .
Surgery with sedation? :(
It doesn't sound like any fun.

Geez, your quick. http://www.short-media.com/forum/images/smilies/thumbsup.gif http://www.short-media.com/forum/images/smilies/rainbow12.gif
And drowd, I think your right. Usually malpractice(that is what this would be considered, right) lawsuits are atleast 100,000, and usually in the millions. But this was in Austria, where they have not turned sueing into a national past time which is more popular than football, basketball, and baseball combined.
no kidding. i hate how everyone is lawsuit happy. i always think of that lady that spilled the mcdonalds coffee between her legs. i mean, i know she got some pretty bad burns, but come on. coffee is supposed to be furiously hot . . .

My brother worked in a vet surgery for a while (on work exp) and a dog woke up during surgery when they were doing some dental work. Needless to say, when they noticed it wake, they pumped it full of knockout drugs (I dunno what they use) but anyway, they almost OD'ed it. I'm betting the owner never heard a peep and the operation went all "rosy".

It's simple as, there are things you sue for and things you don't. Use this simple quiz to decide if you should sue.
1) Did you get pwned because of your own friggen stupidity?

If you've answered yes to any of the above questions then you are a moron and should not sue!
Should not != won't win if they do sue though and thats the problem. People getting payouts for tripping over cracks in the footpaths and stupid things like that.

If its been reported....
In the UK. and I am sure elsewhere we PAY for the council to repair cracks, so I wouldnt mind people getting cash for this.... might get the council to do some work..
Or we could just allow the council to get away with it.... and guess what.. why would they even bother to fix the dam footpaths?
:o that is one of those things i would sue about, omg, imagine being awake! ;[
but people suing over stupid shit like "fast food restaurants forced me to eat there and made me fat, gimme a bajillionty dollars!!$@(%_@PO@(#1111seven" is stupid and a disgrace to americans ;[;[;[

Do europeon countrys in general have limits on malpractice lawsuits? I'd imagine that there is (at least where that was) because of the ammount hey asked for.

Ok perhaps a bad example. But my point is that people are nowadays finding someone else to blame for their incompetance.

Maybe she was crunching numbers on how much the lawsuit was worth?
