Canadian Court Rules Music Downloading Legal

edited April 2004 in Science & Tech
Individuals who share personal copies of music files on the internet are safe after a Federal Court rejected a motion on Wednesday that would have allowed the music industry to sue them.

[blockquote]No evidence was presented that the alleged infringers either distributed or authorized the reproduction of sound recordings," von Finckenstein wrote in his 28-page ruling. "They merely placed personal copies into their shared directories which were accessible by other computer users via a P2P service.[/blockquote]

Given how strong his wording was and the current tax on all media I don't forsee this ruling getting overturned. New laws may be made making sharing clearly infringement but the way the law is written his intepretation seems reasonable (as is confirmed by an IP lawyer friend). Of course the true meaning of this (no digital content is safe in Canada) will force the government to compromise somehow. Canadians aren't going to like an American style prison given the power we've just been given so I expect a much more balanced approach to Canadian laws.

Remember its NOT theft, its copyright infringement. No one would ever call patent infringement "patent theft" so why do we accept the music companies lying to us about our own laws?
