    I think their only angle would be that the Terms themselves are illegal. Psystar tried the same thing against Apple. Didn't work for them, either.

    I am not a XBox user but I would say there should be a way to upgrade the unit without restrictions as long as piracy was not involved. As I understand a simple hard drive upgrade could trigger the ban. After all I don't see a computer manufacturer limiting upgrade options.
