  This is an invasive effort of the government that I approve of. I don't know how I feel about that.

  This is your personal equipment, it should be an opt-in kind of thing and not a requirement.

  You will be "opting in" by electing to use Xbox Live or the PS3 Network, etc.

  The government has done a pretty good job of making sure that the EBS never got abused, I don't see why they would fail to regulate this service properly.
