Microsoft No Match For Student

For the past four months, Zamos has been fighting four high-powered Microsoft attorneys. They claimed he violated trademark and copyright laws by selling two unopened pieces of software on eBay for $203.50.

The honchos at Bill Gates’ empire probably thought it would be an easy, open-and-shut case, just like the 1,045 similar suits they have filed.

It wasn’t any particular genius or advanced legal skills that made Zamos different from the other defendants. It wasn’t even that he was right. He simply did his homework — and outplayed the lawyers at their own game.

    Garg A great story :thumbsup:. I don't think I would have had the patience to sift through that much legalese. It's too bad he had to sign the NDA, it would have been nice to shame Microsoft some more.

    GHoosdum I just read the whole thing. Good story! It casts Microsoft in the same big-guy-picking-on-the-plebians light that the RIAA is in lately. I hate it when big corps think they can push people around (even when the corp is in the wrong) just because they have lawyers and money. :shakehead

    Jolyon33 OMG, that is just too rich. It's just too bad that he settled with Microsoft at all. It would have been much more fun to embarrass the "evil empire" for a while on the afternoon and late-night talk shows. Serves Microsoft and its lawyers right.

    My only wish is that he'd not settled, and fought it all of the way - then it would have been a glorious victory, and we would all watch a movie about it in a few years.

    A movie would have been AWESOME. That would embarass Microsoft on an unimaginable scale, and might finally have changed the practices of big music, big movies, and big software when it comes to their harassment tactics.

    Stupid NDA. Maybe someone else could make an "inspired by" movie.

    Private_Snoball Awesome job by this kid, sounds like microsoft bit off more than it wanted to chew there. They could handle it, but damn that's a waste of funds. In Microsofts defence, this is like 1 case out a thousand that was unfair, if they let anything slide it would be everywhere and then everyone would be out trying to do the same. It's a terrible case, but a big business has a lot of enemies, and lots of people who are looking for that one way to bring them down. But still, damn Zamos is a ballsy sumabitch

    Anyone seen "Antitrust" ? If that movie isnt a stab at Microsoft then nothing is :)
