Abington IP threatens lawsuit over Xbox LIVE ban

US law firm Abington IP called for any of the some one million users affected by the recent Xbox LIVE ban to come forward to support plans for a class action  lawsuit.

Microsoft says it is not worried about the possibility of the suit, as the firm believes it is within its rights.

“Microsoft is well within its legal rights to ban these users from Xbox Live,” comments a Redmond spokesperson. “Piracy is illegal and modifying an Xbox 360 is a violation of the Xbox Live Terms of Use.”

Abington IP has not yet committed to the law suit, as it is most likely attempting to discover whether enough people will come forward to make a case. Even if Abington IP goes ahead with the suit, they will be hard pressed to make a good case, as the Xbox LIVE bans only targeted users who broke the TOU.

    AlexDeGruven I think their only angle would be that the Terms themselves are illegal. Psystar tried the same thing against Apple. Didn't work for them, either.
  2. Clifford I am not a XBox user but I would say there should be a way to upgrade the unit without restrictions as long as piracy was not involved. As I understand a simple hard drive upgrade could trigger the ban. After all I don't see a computer manufacturer limiting upgrade options.
