Brazen Mac cloner Psystar has settled without trial in northern California, agreeing to pay Apple $2.7 million in a settlement. This payment ends a large chunk of the legal wrangling between the firms, but does not end the ongoing case in Florida.
In a filing submitted yesterday morning, the two companies agreed that Apple’s claims of copyright infringement and DMCA violation should go in Apple’s favor, as well as Psystar’s counter-suits which alleged copyright abuse and unenforceability.
Of the $2.7 million settlement, $1.34 million is from damages, while the other $1.34 million (and change) will go to settle outstanding attorney fees. However, given that Psystar only recently emerged from bankruptcy, it seems equally probable that Apple could have been paid in glittering ponies and snozberries.
With California off the docket, Apple will now turn its sole focus to the ongoing copyright case in Florida is set to continue under the discretion of Judge Hoeveler on December 14.
Interesting note: Apple has not yet chosen to litigate the Rebel EFI adapter which allows end users to install Mac OS X on the PC. Might Psystar once again get itself into hot water by selling its EFI emulator at a later date?
