RIAA sues 261 file swappers

On Monday, the RIAA (Recording Industry Association of America) said it has filed a total of 261 lawsuits against suspected file swappers. The charges that will be brought against them will be that of "egregious" copyright infringement.
After long years avoiding direct conflict with file
swappers who might also be record buyers, industry executives said they have lost patience. Monday's lawsuits are just the first wave of what the group said ultimately could be "thousands more" lawsuits filed over the next few months.

    These guys (RIAA) are REALLY serious this time. Looks like the first group to receive painful letters will be those with 1000 or more songs in shared folders. Apparently, this is not at all a bluff.

    I think their amnesty offer is still good. There is a link for it in the CNet article linked by Spinner. I think the 'clean slate' server is taking a lot of hits - I couldn't access it.

    The problem with the amnesty is that it only provides for songs/Artists that the RIAA is after. If you have one from an artist which is not represented by the RIAA, they can still sue you (they = the artist)

    The Fifth Amendment to the Constitution of the United States:

    "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb, nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use without just compensation."

    In other words, no defendant shall be compelled to incriminate himself. A person may refuse to answer questions when charged with a crime if he believes answering the questions could provide evidence against him.

    I swear to god. The people who allow sharing of files, and even use the shared folder DESERVE to be caught.

    I'll worry about the RIAA when they jump into bed with the Canadian Government.

    Until then, I'll enjoy downloading media off of the millions of idiots the RIAA can target. :)

    I really wish the RIAA would just die and go away already... Geesh, nothing like beating a dead horse... Their way of life is over, they need to get a new model of business and move on instead of digging in and getting drowned by the current rushing over them...

    The Fifth Ammendment clearly applies to criminal trials, not civil suits. There is no such thing as the "right to remain silent" in a civil suit, nor is there double jeapordy, etc. All these catch phrases popularized by Law & Order simply don't apply. In fact, the regulations for a deposition in a civil suit are so loose that the only thing you can object to is form of the question. Trust me, I should know after four years of an ongoing lawsuit.

    You can be compelled to testify as a defendant, you CAN implicate your own liability, and anybody who thinks that this so-called "amnesty" offer is worth half a crap needs their head examined. The RIAA can still sue anybody they want. The only thing the "amnesty" arrangement changes is that now the RIAA will have thousands, if not millions of people admitting in writing how many songs they stole, when they stole them, how they stole them, etc. Brilliant move on the RIAA's part.

    S-M'ers, think twice before filing for "amnesty".
