Federal district judge Dale A. Kimball has recently upheld a prior court decision that grants Novell declaratory relief, $2.54 million with interest, and dismissal of SCO’s latest claims.
While this legal brouhaha has been happening for many, many years, it appears that the case may finally be drawing to a close. Though SCO is eligible for an appeal in this circumstance, it is unlikely that the ailing and financially-strapped firm will be able to do so. Slapped with a $2.54 million bill, SCO has only managed to summon $625,000 for the constructive trust that has been prepared to pay Novell for damages awarded.
